Here are the 6 key conditions you should check before contacting your Ausländerbehörde.
1. Have You Been in Germany for 3 Years?
You generally need to have held a German Aufenthaltserlaubnis for at least three years.
2. Do You Work at Least 20 Hours a Week?
For this specific spouse route, employment of at least 20 hours per week is generally required. Your employment must also be legally permitted. (make-it-in-germany.com)
3. Are You Still Living Together?
The marriage must continue as a genuine marital partnership, with the spouses living together in Germany.
4. Is Your German at Least B1?
You generally need B1 German language skills. If you have not yet reached B1, this can be one of the biggest hurdles.
5. Have You Passed the “Leben in Deutschland” Test?

6. Can You Support Yourself?

But Here's the Catch
This 3-year route does not apply to every spouse living in Germany.
The special rule applies to spouses of certain skilled workers who hold a settlement permit under §18c AufenthG.
